Privacy Policy

Earmark Audio is owned and operated by Viselio, LLC, a Michigan limited liability company ("Viselio," "we," "us," or "our"). This document is a working draft prepared for attorney review and has not yet been finalized as a binding legal agreement.

1. Overview

This Privacy Policy explains how Viselio, LLC ("Viselio," "we," "us," or "our") collects, uses, shares, and protects information in connection with the Earmark Audio website and application (the "Service"). This Policy is part of, and should be read together with, our Terms of Service.

2. Information We Collect

2.1 Information you provide directly

  • Account information: name, email address, password (stored in hashed/encrypted form), and authentication data if you sign in through a third-party provider such as Google.
  • Billing information: when you subscribe to a paid plan, payment details are collected and processed by our third-party payment processor (e.g., Polar.sh). We do not directly store full payment card numbers.
  • Preferences: the YouTube channels/shows you choose to follow, digest delivery settings, and any communications you send us (e.g., support requests).

2.2 Information collected automatically

  • Usage data: pages and features you access, digest open and click activity, device and browser type, IP address, and similar diagnostic data.
  • Cookies and similar technologies: used to keep you signed in, remember preferences, and understand aggregate usage of the Service. You can control cookies through your browser settings; disabling them may affect functionality.

2.3 Information about third-party video content

To generate Recap Content, we process publicly available data associated with YouTube videos and channels — including video titles, descriptions, transcripts/captions, and metadata — for channels our users choose to follow. This data concerns publicly published video content, not private individuals, and is processed to generate the recaps and synthesis described in Section 2 of our Terms of Service.

3. How We Use Information

  • To provide, maintain, and improve the Service, including generating and delivering your personalized digest.
  • To process payments and manage subscriptions.
  • To communicate with you about your account, the Service, and (where you have not opted out) product updates.
  • To monitor, secure, and troubleshoot the Service, including detecting fraud or abuse.
  • To analyze aggregate usage trends so we can improve which shows, features, and extraction depth are prioritized.
  • To comply with legal obligations.

4. How We Share Information

We do not sell your personal information. We share information only in the following circumstances:

  • Service providers: vendors who perform services on our behalf, such as cloud hosting, email delivery, payment processing, and analytics, under contractual obligations to protect your data and use it only for the purposes we specify.
  • Legal and safety reasons: where we believe disclosure is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Viselio, our users, or the public.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, in which case information may be transferred as part of that transaction, subject to standard confidentiality protections.
  • With your consent: in any other circumstance where you have explicitly agreed to the sharing.

5. Data Retention

We retain account information for as long as your account is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated personal information at any time as described in Section 7.

6. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect information we hold. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Your Rights and Choices

  • Access and correction: you may review and update your account information at any time through account settings.
  • Deletion: you may request deletion of your account and associated personal information by contacting privacy@viselio.ai or using the in-app account deletion option. We will honor such requests except where retention is required by law or for legitimate business purposes such as fraud prevention.
  • Communication preferences: you may opt out of non-essential marketing emails at any time via the unsubscribe link in those emails; you will continue to receive essential service communications (such as billing notices) related to your account.
  • Depending on your state of residence, you may have additional rights under applicable state privacy laws (such as the right to know, delete, or opt out of certain processing). To exercise these rights, contact privacy@viselio.ai.

8. Children's Privacy

The Service is not directed to individuals under 18, and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will take steps to delete it.

9. International Users

Viselio, LLC is based in the United States, and information we collect is processed and stored in the United States. If you access the Service from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

10. Third-Party Links and Source Content

The Service links to third-party video content hosted on YouTube and other platforms. Those platforms have their own privacy practices, which we do not control. We encourage you to review the privacy policies of any third-party platform you visit through links provided in the Service.

11. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service or by email before the changes take effect. The "Effective date" at the top of this Policy reflects the most recent revision.
